Bureaucracies with many thousands of employees currently face the challenge of not only monitoring laws and budgets, but also establishing new relationships between intersubjective realities (Harari 2017) and ecological-social consequences.\u003C/p>\u003Cp name=\"446f\" id=\"446f\" class=\"graf graf--p graf-after--p\">In Germany, nationwide strategies for the future and innovation focus mainly on the promotion of technologies for solving complex societal problems (BMBF 2017). This is understandable, but it has been proven that technological innovations can only contribute to a desirable transformation of our society if they can be effective in conjunction with social innovations and experience cultural embedding (Buchanan 2001, Jahn et al 2012).\u003C/p>\u003Ch3 name=\"6e1d\" id=\"6e1d\" class=\"graf graf--h3 graf-after--p\">Facing complexity\u003C/h3>\u003Cp name=\"e4a2\" id=\"e4a2\" class=\"graf graf--p graf-after--h3\">Especially in the area of ​​law-making, problems emerge for which not only one suitable solution can be considered, but where their framing by the actors is disputed; where causes of problems, goals and responsibilities are the subject of a discursive debate (Hagan 2017). In order to deal with these so-called “wicked problems” (Rittel and Webber 1973, Buchanan 1992, Checkland et al 2006, Ferlie et al. 2011) transdisciplinary approaches and organizational learning processes are particularly considered in the fields of transformation and administration (Jacob et al. 2015).\u003C/p>\u003Cp name=\"4c5a\" id=\"4c5a\" class=\"graf graf--p graf-after--p\">In the case of unclear problem profiles and “soft” goals, therefore, there is a need for social learning processes that contribute to the adaptation of leading variables, goals or discursive framing and are referred to as “double-loop learning” (Agyris and Schön, 1996). Practice shows that this learning is very much in demand and is difficult to implement in organizations, because “double-loop learning” occurs when mistakes are identified and corrected in a way that incorporates changes in the underlying norms, policies, and goals of an organization (Smith 2001).\u003C/p>\u003Ch3 name=\"1991\" id=\"1991\" class=\"graf graf--h3 graf-after--p\">Experimenting legitimately\u003C/h3>\u003Cp name=\"4648\" id=\"4648\" class=\"graf graf--p graf-after--h3\">In order to meaningfully accompany the associated learning processes in the policy cycle, for several years now, innovation spaces in the public sector have been experimenting with participatory and creative methods (Bason 2010, 2017). For this, legitimate experimental spaces within political-administrative structures are helpful, in which overarching questions can be dealt with and concrete results can emerge.\u003C/p>\u003Cp name=\"e9cd\" id=\"e9cd\" class=\"graf graf--p graf-after--p\">It should be emphasized that there is a continuous engagement with design approaches that deliberately place people in their environment at the center of the development of public products, services and change processes (Buchanan 2007, Junginger 2015). Approaches from human-centered design combine creativity with feasibility. Ideas are designed and realized for processes and things that are intuitive and valuable, with which people like to interact. There are several areas defined by the nature of the challenge that needs to be addressed, from information, products and services to organizations and systems (see Matrix Buchanan). The collective intelligence of the participants is used to develop practical answers to challenges that are specifically geared to the needs and issues of the affected target groups.\u003C/p>\u003Ch3 name=\"2b7d\" id=\"2b7d\" class=\"graf graf--h3 graf-after--p\">Documentation of the cooperation\u003C/h3>\u003Cp name=\"83d9\" id=\"83d9\" class=\"graf graf--p graf-after--h3\">Legal design provides ways to assess and develop information and interactions throughout the legal cycle. The focus is on how applicable,meaningful, and motivational the respective products and services are to the people who create and use them (Hagan 2017).\u003C/p>\u003Cfigure name=\"0d4d\" id=\"0d4d\" class=\"graf graf--figure graf-after--p\">\u003Cimg class=\"graf-image\" data-image-id=\"1*3hGs5TpOWWVyG0Fs__oDJg.jpeg\" data-width=\"886\" data-height=\"886\" data-is-featured=\"true\" src=\"https://cdn-images-1.medium.com/max/800/1*3hGs5TpOWWVyG0Fs__oDJg.jpeg\">\u003Cfigcaption class=\"imageCaption\">Fig.: Paulick-Thiel, 2017\u003C/figcaption>\u003C/figure>\u003Cp name=\"bcd5\" id=\"bcd5\" class=\"graf graf--p graf-after--figure\">By involving relevant target groups, legal design can open up very different possibilities:\u003C/p>\u003Cp name=\"49c5\" id=\"49c5\" class=\"graf graf--p graf-after--p\">· Communicating information in a more meaningful and understandable way\u003C/p>\u003Cp name=\"f9d8\" id=\"f9d8\" class=\"graf graf--p graf-after--p\">· Promoting the development of ideas for desirable products and services\u003C/p>\u003Cp name=\"af49\" id=\"af49\" class=\"graf graf--p graf-after--p\">· Integrating social and technological innovations within or between organizations\u003C/p>\u003Cp name=\"0c1c\" id=\"0c1c\" class=\"graf graf--p graf-after--p\">· Supporting empathic interactions between people and impact-oriented collaboration\u003C/p>\u003Cp name=\"6c34\" id=\"6c34\" class=\"graf graf--p graf-after--p\">In order to not only refer to internationally successful examples, employees of the German Federal Government have tested human-centered design approaches on the basis of a relevant legislative challenge.\u003C/p>\u003Ch3 name=\"4817\" id=\"4817\" class=\"graf graf--h3 graf-after--p\">Too much data, too little information\u003C/h3>\u003Cp name=\"9348\" id=\"9348\" class=\"graf graf--p graf-after--h3\">The Better Regulation Unit of the German Federal Chancellery is frequently faced with the task of clearly and convincingly presenting the processes and functions that are required to draft laws and ordinances, as well as to ensure quality and improve standards. In the international context, the OECD, for example, is an organization that regularly gathers information from its member countries, which is intended for the implementation of recommendations on regulation policy. For this purpose, member countries answer a survey containing over 420 questions.\u003C/p>\u003Cfigure name=\"5904\" id=\"5904\" class=\"graf graf--figure graf-after--p\">\u003Cimg class=\"graf-image\" data-image-id=\"1*dNoL1RbifhSIX_yLko1vAQ.png\" data-width=\"1297\" data-height=\"968\" src=\"https://cdn-images-1.medium.com/max/800/1*dNoL1RbifhSIX_yLko1vAQ.png\">\u003Cfigcaption class=\"imageCaption\">Fig.: OECD, 2017\u003C/figcaption>\u003C/figure>\u003Cp name=\"c4d6\" id=\"c4d6\" class=\"graf graf--p graf-after--figure\">The data collection focuses on instruments for regulatory impact assessment, the participation of those affected and evaluation. In the future, a further aim will be to identify how the member countries organise oversight and quality management. For this, an extension of the questionnaire was developed.\u003C/p>\u003Ch3 name=\"16c7\" id=\"16c7\" class=\"graf graf--h3 graf-after--p\">Avoiding false conclusions\u003C/h3>\u003Cp name=\"9e07\" id=\"9e07\" class=\"graf graf--p graf-after--h3\">In the context of this questionnaire, in consultation with Unit 133 and the OECD, research has been done on how to gather information and improve cooperation between professionals. The study revealed that questionnaires are not sufficiently suitable for collecting the necessary data or deriving meaningful representations or even drawing conclusions. Some quotes from experienced users who tested the OECD’s draft questionnaire extension were:\u003C/p>\u003Cp name=\"bf43\" id=\"bf43\" class=\"graf graf--p graf-after--p\">P1: “Unfortunately, I have not consistently succeeded in grasping the questions or the apparent assumptions that were used in their formulation.”\u003C/p>\u003Cp name=\"fefb\" id=\"fefb\" class=\"graf graf--p graf-after--p\">P2: “The requested answering of the questions was only partially possible for me. I am afraid it will be the same later on, even with the finalized questionnaire, and this could lead to false or disadvantageous results.”\u003C/p>\u003Cp name=\"79d1\" id=\"79d1\" class=\"graf graf--p graf-after--p\">P 2: “I also was not able to achieve a comprehensible illustration of the respective legislative process by answering the individual questions or by merely rephrasing them.”\u003C/p>\u003Ch3 name=\"730c\" id=\"730c\" class=\"graf graf--h3 graf-after--p\">Making meaningful connections\u003C/h3>\u003Cp name=\"d55d\" id=\"d55d\" class=\"graf graf--p graf-after--h3\">Information about the organization and scope of quality management can only be presented and analyzed meaningfully in connection with information on the regulatory process itself and the use of the instruments mentioned. The guiding question for the further work process was:\u003C/p>\u003Cp name=\"c9ca\" id=\"c9ca\" class=\"graf graf--p graf-after--p\">How can we improve the collection, mapping and analysis of data in the context of legislative procedures?\u003C/p>\u003Cp name=\"6c65\" id=\"6c65\" class=\"graf graf--p graf-after--p\">In order to find possible answers, an explorative procedure and corresponding methods were required. The same applies to similar tasks within the Federal Government. In addition to traditional textual and graphical representations such as lists, organigrams, or charts representing the allocation of duties, new mapping opportunities should be developed and tested as part of the expert consultation.\u003C/p>\u003Ch3 name=\"f3e3\" id=\"f3e3\" class=\"graf graf--h3 graf-after--p\">Research of possible approaches\u003C/h3>\u003Cp name=\"0597\" id=\"0597\" class=\"graf graf--p graf-after--h3\">For inspiration a variety of images of processes were examined that show people interacting with products or systems. Especially in the area of ​​service design, “user journeys” can illustrate one or more user groups in different situations, e.g. in everyday life or in a service system. The aim was to interactively integrate the participants’ expertise into mapping the legislative process and to identify specific information on quality assurance during the respective procedural options. Instead of an extensive questionnaire, which is often filled out by one person alone, two teams of four people each worked in parallel to create a prototype mapping. Reliable statements on efforts for implementation are a prerequisite for reducing unnecessary bureaucracy and reducing information loss through data collection, open-ended analysis and interpretation.\u003C/p>\u003Cp name=\"28e1\" id=\"28e1\" class=\"graf graf--p graf-after--p\">\u003Cstrong class=\"markup--strong markup--p-strong\">Comprehensibility:\u003C/strong> Tools for the better understanding of draft legislation (beyond the wording) and target group-specific processing, in order to promote data literacy, clarity and quality of data handling.\u003C/p>\u003Cp name=\"b606\" id=\"b606\" class=\"graf graf--p graf-after--p\">\u003Cstrong class=\"markup--strong markup--p-strong\">Collaboration:\u003C/strong> more collegiality between the various instances, because cooperation is the basis for mapping complex contexts and gaining acceptance from (political) clients to act more freely and innovatively.\u003C/p>\u003Ch3 name=\"7b55\" id=\"7b55\" class=\"graf graf--h3 graf-after--p\">Criteria for the suitability of methodological approaches in the legislative context\u003C/h3>\u003Cp name=\"12c5\" id=\"12c5\" class=\"graf graf--p graf-after--h3\">According to evaluation by the workshop participants, the methodological approach and the “Process Journey Toolkit” are suitable for further use in the national and international legislative context by employees in ministries or other persons, who are e.g. only secondarily involved.\u003C/p>\u003Cp name=\"88e3\" id=\"88e3\" class=\"graf graf--p graf-after--p\">The developed approach supports the discovery of real processes and offers a qualitative insight into different system logics. The instruments can be used in a variety of ways, for example for self-evaluation, for the parallel mapping of desired and actual states or in the international comparison of quality assurance instruments in regulatory policy.\u003C/p>\u003Cp name=\"2fce\" id=\"2fce\" class=\"graf graf--p graf-after--p\">Important for working with it is the definition of the task and what is being worked toward. He co-directs ANZSOG’s Deputies Leadership Program with Kathryn Anderson, that integrates a significant focus on the evolution of leadership responses to the opportunities and risks of digital, data and AI capabilities and platforms.\u003C/p>\n\u003Cp>From 2001 to 2013, Martin led the Asia-Pacific public sector consulting and innovation team in Cisco’s Internet Business Solutions Group (IBSG). He led strategy and design work on digital transformation and public policy and public sector reform projects in government, education, health, human services and urbanisation in India, China, South-East Asia, Australia and New Zealand.\u003C/p>\n\u003Cp>Prior to his role in Cisco, Martin held various policy and management roles in the federal public sector, including Chief of Staff to a Minister in the Federal Government, a federal public servant (Communications, Sport, Recreation and Tourism) and as a research and strategy lead in the Office of Strategic Planning in the NSW Cabinet Office. For the past three years, and again in 2026, he has been a Learning Guide and facilities for the NSW Leadership Academy (Band 1 and Band 2 senior executives).\u003C/p>\n\u003Cp>He chaired the former NSW Digital Government Advisory Panel and the Expert Advisory Group for the Welfare Payments Infrastructure Transformation program (WPIT) for the former federal Department of Human Services (now Services Australia).\u003C/p>\n\u003Cp>He was a member of the Government 2.0 Task Force established by Federal Minister for Finance, Lindsay Tanner, in 2009. In 2017, Martin was one of 3 members of a review for the NSW Government, chaired by former NSW Premier Nick Greiner AC, of regulatory policy and strategy across the State.\u003C/p>\n\u003Cp>He was an inaugural member of the NSW AI Advisory Group which crafted the early versions of what has now become the NSW AI Assurance Framework which is also being adapted as a national AI assurance framework.\u003C/p>\n\u003Cp>Martin writes and speaks extensively on government, service design, digital transformation, the impact of AI in government and on public leadership for the digital age as well as on different dimensions of policy reform.
