But technology offers the promise of opening how lawmaking bodies work to new sources of expertise and opinion and making lawmakers accountable to the public more on more than just Election Day. Around the world, there are already over two dozen examples of local legislatures and national parliaments turning to the Internet to involve the public. We call such open and participatory lawmaking: “crowdlaw.”\u003C/p>\u003Ch3 name=\"f703\" id=\"f703\" class=\"graf graf--h3 graf-after--p\">The Crowd.Law Website\u003C/h3>\u003Cp name=\"02d8\" id=\"02d8\" class=\"graf graf--p graf-after--h3\">Although legislatures fund the research done in universities, they invest next to nothing in researching and reinventing how they themselves work. Thus, the \u003Ca href=\"http://www.thegovlab.org/\" data-href=\"http://www.thegovlab.org/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">Governance Lab\u003C/a> at New York University is launching the \u003Ca href=\"http://www.thegovlab.org/project-crowdlaw.html\" data-href=\"http://www.thegovlab.org/project-crowdlaw.html\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">CrowdLaw Research Initiative\u003C/a> and \u003Ca href=\"http://thegovlab.org/legislature-2-0/crowd.law\" data-href=\"http://thegovlab.org/legislature-2-0/crowd.law\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">website\u003C/a> (“CrowdLaw”) to understand the future impact of technology on the lawmaking process, in particular those technologies that enable participation by individuals and groups. We focus on these collective intelligence tools — as distinct from the technology that enables greater legislative transparency — because they offer the potential for a two-way conversation that could channel more and more diverse opinions and expertise into the lawmaking process and may thereby improve the quality of legislation and its efficacy.\u003C/p>\u003Cp name=\"a671\" id=\"a671\" class=\"graf graf--p graf-after--p\">The focus is on creating not only more direct, but also more informed democracy. and\u003C/li>\u003Cli name=\"a21e\" id=\"a21e\" class=\"graf graf--li graf-after--li\">\u003Ca href=\"https://crowd.law/crowdlaw-model-legislation-annotated-30f864593e2\" data-href=\"https://crowd.law/crowdlaw-model-legislation-annotated-30f864593e2\" class=\"markup--anchor markup--li-anchor\" rel=\"noopener\" target=\"_blank\">Model language\u003C/a> for legislating public engagement in lawmaking.\u003C/li>\u003C/ol>\u003Cp name=\"3134\" id=\"3134\" class=\"graf graf--p graf-after--li\">This work is informed by three online convenings among crowdlaw practitioners from more than a dozen countries\u003Ca href=\"http://thegovlab.org/legislature-2-0/#_edn1\" data-href=\"http://thegovlab.org/legislature-2-0/#_edn1\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">1\u003C/a> and a semester-long \u003Ca href=\"https://law.yale.edu/yls-today/news/clinic-explores-citizen-participation-lawmaking-parliamentary-conference\" data-href=\"https://law.yale.edu/yls-today/news/clinic-explores-citizen-participation-lawmaking-parliamentary-conference\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">graduate research project\u003C/a> undertaken at Yale University in the Yale Law School’s \u003Ca href=\"https://www.publicentrepreneur.org/yale-projects\" data-href=\"https://www.publicentrepreneur.org/yale-projects\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">Clinic on Governance Innovation\u003C/a>.\u003C/p>\u003Ch3 name=\"f204\" id=\"f204\" class=\"graf graf--h3 graf-after--p\">Future CrowdLaw Activities in&nbsp;2018\u003C/h3>\u003Cp name=\"26b5\" id=\"26b5\" class=\"graf graf--p graf-after--h3\">The launch of Crowd.Law is only the beginning of a series of activities for the coming year designed to deepen our understanding of CrowdLaw practices, convene the community interested in legislative innovation, pilot additional CrowdLaw experiments in practice and study what works.\u003C/p>\u003Cp name=\"55fd\" id=\"55fd\" class=\"graf graf--p graf-after--p\">To that end, on November 17th, the Madrid Regional Assembly and the Madrid City Council will convene a workshop on CrowdLaw together with the GovLab at NYU and the Harvard Study Group “The challenge to design a technological Agora” designed to investigate potential pilot projects on CrowdLaw for lawmaking at the local and regional level in Spain.\u003C/p>\u003Cp name=\"c888\" id=\"c888\" class=\"graf graf--p graf-after--p\">This Spring, the GovLab and multi-disciplinary students from New York University’s Tandon School of Engineering in \u003Ca href=\"https://www.publicentrepreneur.org/tcs-governing-the-city\" data-href=\"https://www.publicentrepreneur.org/tcs-governing-the-city\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">Governing the City\u003C/a> will undertake research for the city council of a large metropolis to map how a bill becomes a law and, in turn, how that law gets implemented into regulations, in an effort to identify the benefits and risks of greater public engagement.\u003C/p>\u003Cp name=\"348f\" id=\"348f\" class=\"graf graf--p graf-after--p\">With support from the Rockefeller Foundation, the Governance Lab will convene political and legal theorists, parliamentarians, platform designs and legislative staff from six continents at the Rockefeller Bellagio Conference Center in Italy in March to explore the theory and practice of public engagement in lawmaking and to set standards for data collection and sharing by parliaments practicing crowdlaw to enable evidence-based research.\u003C/p>\u003Ch3 name=\"eb71\" id=\"eb71\" class=\"graf graf--h3 graf-after--p\">Why CrowdLaw?\u003C/h3>\u003Cp name=\"a5a3\" id=\"a5a3\" class=\"graf graf--p graf-after--h3\">Today the public, with the exception of interest group lobbyists, has very little impact on governing. There’s a vast literature on the infirmities of the legislative process, which explain the causes that have given rise to poor quality. As Jacob Hacker and Paul Pierson conclude in \u003Ca href=\"http://www.simonandschuster.com/books/Winner-Take-All-Politics/Jacob-S-Hacker/9781416588702\" data-href=\"http://www.simonandschuster.com/books/Winner-Take-All-Politics/Jacob-S-Hacker/9781416588702\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">Winner Takes All Politics\u003C/a>, the multi-billion dollar lobbying machine of organized business that emerged in the 1970s to combat Great Society social programs has captured the political process and continuously pushed through a legislative agenda designed to favor the very rich over the middle class. Their book-length work chronicles the exclusion of the “every man” from politics and the resulting inequality in American society. In David Schoenbrod’s \u003Ca href=\"http://www.dc-confidential.org/\" data-href=\"http://www.dc-confidential.org/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">DC Confidential\u003C/a>, he lays out the “five tricks” politicians use to take credit while passing the blame and the buck to future generations for their bad legislation. As another study concluded: “the preferences of the average American appear to have only a minuscule, near-zero, statistically non-significant impact upon public policy.”\u003Ca href=\"http://thegovlab.org/legislature-2-0/#_edn2\" data-href=\"http://thegovlab.org/legislature-2-0/#_edn2\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">2\u003C/a>\u003C/p>\u003Cp name=\"ca11\" id=\"ca11\" class=\"graf graf--p graf-after--p\">The unknown question is whether new forms participation beyond the Ballot Box can, in practice, enhance the legitimacy\u003Ca href=\"http://thegovlab.org/legislature-2-0/#_edn3\" data-href=\"http://thegovlab.org/legislature-2-0/#_edn3\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">3\u003C/a> and quality\u003Ca href=\"http://thegovlab.org/legislature-2-0/#_edn4\" data-href=\"http://thegovlab.org/legislature-2-0/#_edn4\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">4\u003C/a> of the lawmaking process and remedy what ails it. It is worth noting that these two goals are in often in tension because one focuses on ensuring that all voices are heard and the other on enhancing expertise in the process. There is no right answer as to which is more important. But most experiments with public engagement in law- and policymaking to date have focused on the former to the exclusion of the latter. They have not resulted in any measurable improvements in legislative outcomes. It will be crucial when designing new pilots to experiment with trying to design platforms and processes to achieve both goals at different stages of the lawmaking process.\u003C/p>\u003Cp name=\"f580\" id=\"f580\" class=\"graf graf--p graf-after--p\">For example, when parliaments decide what issues to take up (agenda-setting), this may be an opportunity to raise the concerns and problems of the community and for the public to propose, prioritize and critique problems to tackle, as is the case of Finland’s \u003Ca href=\"http://openministry.info/finnish-citizens-initiative\" data-href=\"http://openministry.info/finnish-citizens-initiative\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">Citizen’s Initiative Act\u003C/a>, in which a member of the public can propose new legislation. At this stage, participation has the potential to enhance information and bring empiricism into the legislative process through public contribution of expertise.\u003C/p>\u003Cp name=\"25bb\" id=\"25bb\" class=\"graf graf--p graf-after--p\">When legislative and regulatory bodies arrive at the substance of a solution to a problem (proposal-crafting), this could present the opportunity to identify innovative approaches by leveraging distributed expertise beyond that available from legislators and their staffs and occasional hearings\u003Ca href=\"http://thegovlab.org/legislature-2-0/#_edn5\" data-href=\"http://thegovlab.org/legislature-2-0/#_edn5\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">5\u003C/a> and, at the same time, to create a process for gauging public preferences and public opinion in response to proposed solutions. \u003Ca href=\"https://www.parlement-et-citoyens.fr/\" data-href=\"https://www.parlement-et-citoyens.fr/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">Parlement &amp; Citoyens\u003C/a> in France enables citizens to submit proposals on the causes and solutions to a problem posed by a representative. Citizens’ proposals are then synthesized, debated, and incorporated into the resulting draft legislation.\u003C/p>\u003Cp name=\"ea86\" id=\"ea86\" class=\"graf graf--p graf-after--p\">Many of the newer political parties from \u003Ca href=\"https://podemos.info/\" data-href=\"https://podemos.info/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">Podemos\u003C/a> in Spain to the \u003Ca href=\"https://alternativet.dk/en\" data-href=\"https://alternativet.dk/en\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">Alternative\u003C/a> in Denmark have used new technology to invite their constituents to draft the party platform in an effort to assess the opinions of their base and be more responsive to them.\u003C/p>\u003Cp name=\"22da\" id=\"22da\" class=\"graf graf--p graf-after--p\">If parliaments distribute the work of monitoring implementation to citizens with \u003Ca href=\"http://promisetracker.org/2017/05/23/initial-findings-from-para/\" data-href=\"http://promisetracker.org/2017/05/23/initial-findings-from-para/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">camera-phones\u003C/a>, for example, this could dramatically increase the ability to evaluate the downstream cost and benefits of legislation on people’s lives and introduce into lawmaking greater empirical rigor, which is typically lacking. \u003Ca href=\"http://thegovlab.org/legislature-2-0/#_edn6\" data-href=\"http://thegovlab.org/legislature-2-0/#_edn6\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">6\u003C/a> \u003Ca href=\"http://thegovlab.org/legislature-2-0/#_edn7\" data-href=\"http://thegovlab.org/legislature-2-0/#_edn7\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">7\u003C/a> \u003Ca href=\"http://thegovlab.org/legislature-2-0/#_edn8\" data-href=\"http://thegovlab.org/legislature-2-0/#_edn8\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">8\u003C/a> \u003Ca href=\"http://thegovlab.org/legislature-2-0/#_edn9\" data-href=\"http://thegovlab.org/legislature-2-0/#_edn9\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">9\u003C/a> \u003Ca href=\"http://thegovlab.org/legislature-2-0/#_edn10\" data-href=\"http://thegovlab.org/legislature-2-0/#_edn10\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">10\u003C/a>\u003C/p>\u003Cp name=\"63b4\" id=\"63b4\" class=\"graf graf--p graf-after--p\">Yet it is not self-evident that more public participation per se produces wiser or more just laws. There are countless instances to the contrary, including notable recent plebiscites. Rather than improve the informational quality of legislation, opening up decision-making may end up empowering some more than others and enable undue influence by special interests. More direct participation could lead to populist rule with negative outcomes for civil liberties. Legislatures are rightly slow to implement public engagement, fearing that participation will be burdensome, at worst, and useless at best.\u003C/p>\u003Cp name=\"c3ca\" id=\"c3ca\" class=\"graf graf--p graf-after--p graf--trailing\">To counter these risks and realize the benefits, there is an urgent need for systematic experimentation and assessment to inform and guide how legislatures engage with the public to collect, analyze and use information as part of the lawmaking process. He co-directs ANZSOG&rsquo;s Deputies Leadership Program with Kathryn Anderson, that integrates a significant focus on the evolution of leadership responses to the opportunities and risks of digital, data and AI capabilities and platforms.\u003C/p>\n\u003Cp>From 2001 to 2013, Martin led the Asia-Pacific public sector consulting and innovation team in Cisco&rsquo;s Internet Business Solutions Group (IBSG). He led strategy and design work on digital transformation and public policy and public sector reform projects in government, education, health, human services and urbanisation in India, China, South-East Asia, Australia and New Zealand.\u003C/p>\n\u003Cp>Prior to his role in Cisco, Martin held various policy and management roles in the federal public sector, including Chief of Staff to a Minister in the Federal Government, a federal public servant (Communications, Sport, Recreation and Tourism) and as a research and strategy lead in the Office of Strategic Planning in the NSW Cabinet Office. For the past three years, and again in 2026, he has been a Learning Guide and facilities for the NSW Leadership Academy (Band 1 and Band 2 senior executives).\u003C/p>\n\u003Cp>He chaired the former NSW Digital Government Advisory Panel and the Expert Advisory Group for the Welfare Payments Infrastructure Transformation program (WPIT) for the former federal Department of Human Services (now Services Australia).\u003C/p>\n\u003Cp>He was a member of the Government 2.0 Task Force established by Federal Minister for Finance, Lindsay Tanner, in 2009. In 2017, Martin was one of 3 members of a review for the NSW Government, chaired by former NSW Premier Nick Greiner AC, of regulatory policy and strategy across the State.\u003C/p>\n\u003Cp>He was an inaugural member of the NSW AI Advisory Group which crafted the early versions of what has now become the NSW AI Assurance Framework which is also being adapted as a national AI assurance framework.\u003C/p>\n\u003Cp>Martin writes and speaks extensively on government, service design, digital transformation, the impact of AI in government and on public leadership for the digital age as well as on different dimensions of policy reform.
