Aunque el gobierno de, por y para el pueblo puede parecer algo evidente, en realidad existen múltiples razones para impulsar la participación. Un objetivo claro es que se trata de una condición previa para diseñar el proceso y la plataforma para conseguirlo.\u003C/p>\u003Cp name=\"bfa0\" id=\"bfa0\" class=\"graf graf--p graf-after--p\">Una revisión completa de la enorme bibliografía académica sobre la participación queda fuera del alcance de este informe, pero aun así vale la pena analizar brevemente las teorías dominantes que fundamentan y justifican la participación pública. Específicamente, identificamos cuatro escuelas de pensamiento sobre los beneficios potenciales de la participación pública. Las tres primeras son las que se citan con mayor frecuencia y han dado lugar a las plataformas y los procesos diseñados para optimizar la deliberación. Esencial para nuestro argumento es que las prácticas de crowdlaw deben aumentar la \u003Cem class=\"markup--em markup--p-em\">calidad de la legislación\u003C/em>, si se las quiere usar y adoptar eficientemente a cierta escala. Así, el cuarto aspecto, como veremos, es seguramente el más importante.\u003C/p>\u003Cul class=\"postList\">\u003Cli name=\"f940\" id=\"f940\" class=\"graf graf--li graf-after--p\">Mejorar la alfabetización cívica y la legitimidad democrática al dar voz a más personas en el proceso,\u003C/li>\u003Cli name=\"8b1a\" id=\"8b1a\" class=\"graf graf--li graf-after--li\">Fortalecer el capital social y la cohesión social, y reducir el partidismo,\u003C/li>\u003Cli name=\"12ab\" id=\"12ab\" class=\"graf graf--li graf-after--li\">Mejorar la responsabilidad democrática al hacer que el gobierno sea más transparente,\u003C/li>\u003Cli name=\"88b5\" id=\"88b5\" class=\"graf graf--li graf-after--li\">Y, generar un gobierno más efectivo al introducir en la manera de gobernar ideas y análisis más diversos de una audiencia amplia.\u003C/li>\u003C/ul>\u003Ch4 name=\"a326\" id=\"a326\" class=\"graf graf--h4 graf-after--li\">\u003Cstrong class=\"markup--strong markup--h4-strong\">1. Mejorar la formación cívica¹\u003C/strong>\u003C/h4>\u003Cp name=\"04bd\" id=\"04bd\" class=\"graf graf--p graf-after--h4\">La legitimidad democrática descansa en la idea que los ciudadanos que se ven sometidos a las consecuencias de una decisión política las consideran justificadas. Por ello la percepción pública de la legitimidad de las instituciones gubernamentales depende, hasta cierto punto, de la creencia en que dichas instituciones actúan por el bien común y no satisfacen indebidamente los intereses de las élites políticas o de un segmento de la sociedad, garantizando que la toma de decisiones resulta transparente y ofreciendo una igualdad de oportunidades al público para que se oiga su voz y aumente la percepción de legitimidad del gobierno.\u003C/p>\u003Cp name=\"29cd\" id=\"29cd\" class=\"graf graf--p graf-after--p\">Así, el objetivo de la participación no es directamente un cambio en el resultado final de la decisión, sino más bien crear — a través de la promoción del discurso público — una oportunidad para la formación y la concreción de la opinión pública. El más conocido de los teóricos y \u003Cem class=\"markup--em markup--p-em\">practitioners\u003C/em> de este estilo \u003Cem class=\"markup--em markup--p-em\">habermasiano\u003C/em> de democracia deliberativa, el profesor de Stanford James Fishkin, plantea que el debate puede asegurar al público general que las acciones políticas son el reflejo de la voluntad política del pueblo. Fishkin comprobó su hipótesis a través «votaciones deliberativas», un proceso que combina los atributos de la votación y del debate «al exponer a un conjunto [de personas] elegido al azar una información equilibrada, animándoles a que valorasen los argumentos opuestos que estaban en discusión con interlocutores heterogéneos, y después recoger sus opiniones más meditadas».² Su diseño y análisis de múltiples experimentos de votación deliberativa descubrió que los participantes no solo cambiaron de opinión como resultado de participar en el proceso de debate, sino que también cambiaron las bases de sus opiniones con «criterios más deseables desde el punto de vista normativo». De manera parecida, el análisis de John Gastil de los participantes en el \u003Cem class=\"markup--em markup--p-em\">National Issues Forum\u003C/em>, otro método de debate practicado desde principios de la década de 1980, mostró que los que asistieron al programa lo terminaron con puntos de vista más complejos y coherentes sobre los temas a debate. Amy Gutmann y Dennis Thompson, a su vez, afirman que este aumento de conocimientos sobre temas importantes fortalece la fe y la percepción de legitimidad de las instituciones políticas porque los ciudadanos consideran que pueden comprender y contribuir a la toma de decisiones políticas complejas. Jürgen Habermas afirma que la democracia deliberativa y una «sociedad civil enérgica» pueden devolver la «esfera pública» a su situación anterior como foro para un diálogo significativo entre los ciudadanos, aumentando el flujo de información en un proceso político que en la actualidad está dominado por los medios de comunicación.\u003C/p>\u003Ch4 name=\"5465\" id=\"5465\" class=\"graf graf--h4 graf-after--p\">\u003Cstrong class=\"markup--strong markup--h4-strong\">2. Fortalecer el tejido social\u003C/strong>\u003C/h4>\u003Cp name=\"02f9\" id=\"02f9\" class=\"graf graf--p graf-after--h4\">Una segunda escuela de pensamiento relacionada con la anterior identifica el papel que juega la participación pública en la vida cívica y comunitaria además de en el proceso político. El análisis de Robert Putnam del «capital social» — «entendido en sentido amplio como las relaciones comunitarias que afectan a las interacciones personales»³ — ha mostrado que esta participación contribuye positivamente a una serie de fines sociales, entre ellos la salud pública y la seguridad, la asistencia a la escuela, el aumento de la riqueza y, por supuesto, la confianza en las instituciones gubernamentales. Así, en las comunidades con un capital social bajo, la introducción de nuevas oportunidades de debate puede fortalecer unos lazos comunitarios débiles, lo que representa una perspectiva atractiva en comunidades desestructuradas a causa del partidismo o la división de clases. Finalmente, Clare Chambers de Cambridge afirma que el debate puede disminuir las tendencias disgregadoras dentro de una comunidad y fortalecer un sentimiento de interdependencia. De esta manera el acto de debatir puede infundir una sensación de familiaridad y reforzar los lazos sociales en el seno de una comunidad, un resultado que tiene efectos positivos tanto en la vida comunitaria como en el proceso político. El debate digital, en mayor medida que el debate offline, produce y difunde con rapidez datos sobre las preferencias de los ciudadanos, con frecuencia en tiempo real.⁴\u003C/p>\u003Ch4 name=\"092d\" id=\"092d\" class=\"graf graf--h4 graf-after--p\">\u003Cstrong class=\"markup--strong markup--h4-strong\">3. Conseguir que el gobierno sea más responsable\u003C/strong>\u003C/h4>\u003Cp name=\"7de5\" id=\"7de5\" class=\"graf graf--p graf-after--h4\">La participación juega también un papel vital en exigir la responsabilidad de los gobiernos, porque la transparencia necesaria para facilitar la participación del público, en teoría, reduce el riesgo de engaños y acuerdos bajo mano. Tradicionalmente, el periodismo de investigación ha servido como este «instrumento de responsabilidad institucional, un medio para conseguir que los gobernantes se ciñan… a los ideales y a las reglas de la política democrática».⁵ Los grupos de control del gobierno también juegan un papel vital en simplificar la información más compleja para otras organizaciones periodísticas y de la sociedad civil. Estos controladores, a los que Walter Lipmann se refiere como «observatorios políticos», pueden existir tanto dentro como fuera del gobierno, y comprometerse con el público a través del «patrocinio de investigaciones, el seguimiento de la actividad gubernamental y, como organizaciones no partidistas o de defensa de temas concretos, generando información sobre el mundo político que esté a disposición de los periodistas y directamente de los ciudadanos».⁶\u003C/p>\u003Cp name=\"5114\" id=\"5114\" class=\"graf graf--p graf-after--p\">Pero el crowdlaw, al implicar al público de una manera mucho más directa en el proceso legislativo, permite aumentar la transparencia, lo que a su vez fortalece la responsabilidad. Michael Schudson afirma que «mientras la información esté a disposición del público, los actores políticos se tienen que comportar como si alguien del público les estuviera prestando atención».⁷ Los esfuerzos de participación pública que implican el acceso a información gubernamental, así como las organizaciones que propician que dicha información esté disponible, pueden promover un aumento de la responsabilidad por parte del gobierno.\u003C/p>\u003Ch4 name=\"1052\" id=\"1052\" class=\"graf graf--h4 graf-after--p\">\u003Cstrong class=\"markup--strong markup--h4-strong\">4. Mejorar la gobernanza\u003C/strong>\u003C/h4>\u003Cp name=\"c766\" id=\"c766\" class=\"graf graf--p graf-after--h4\">Una cuarta escuela de pensamiento se centra en el impacto potencial que las nuevas formas de participación cívica pueden tener en el resultado de la gobernanza. Beth Simone Noveck ha escrito extensamente sobre las maneras de usar la participación pública para mejorar el resultado de las políticas, así como de la acción gubernamental, con un interés especial en el papel que puede jugar la tecnología en generar e incrementar la participación cívica.⁸ El llamamiento de Novacek a una «democracia colaborativa» va más allá del interés en el discurso de los teóricos del debate. En su lugar, la democracia colaborativa implica depositar al menos parte o la totalidad de la autoridad para tomar las decisiones y aplicarlas en manos de los ciudadanos participantes: en lugar de limitar a un simple debate la implicación de los ciudadanos, se les deberá dar la oportunidad de colaborar en el diseño y la elaboración de las soluciones reales para problemas importantes. Este modelo colaborativo permite a los gobiernos captar directamente el conocimiento experto colectivo de la población en el desarrollo de soluciones nuevas y creativas, en lugar de presentarle a los ciudadanos una selección limitada de alternativas. Se trata de una teoría que hunde sus raíces en la creencia que la participación no es simplemente un proceso más legítimo, sino que bien diseñada debería propiciar políticas de alta calidad y servicios mejor diseñados.\u003C/p>\u003Ch4 name=\"bcaf\" id=\"bcaf\" class=\"graf graf--h4 graf-after--p\">\u003Cstrong class=\"markup--strong markup--h4-strong\">De la teoría a la práctica\u003C/strong>\u003C/h4>\u003Cp name=\"02d6\" id=\"02d6\" class=\"graf graf--p graf-after--h4\">\u003Cstrong class=\"markup--strong markup--p-strong\">Vale la pena recalcar que hasta la fecha la mayoría, por no decir todas, las plataformas de participación han sido diseñadas para mejorar la legitimidad democrática a través del debate en lugar de mejorar los resultados de la gobernanza.\u003C/strong> Por eso muchos de estos sistemas de democracia digital «han heredado» los retos y las consideraciones de la participación pública offline, es decir, mal diseño, sesgo partidista y, sobre todo, irrelevancia para la gobernanza.⁹ En un círculo vicioso, plataformas diseñadas para el debate, pero no necesariamente para mejorar la gobernanza, acaban teniendo muy poco impacto en las decisiones o las acciones de las instituciones, disminuyendo la relevancia de la participación y reduciendo el incentivo para participar tanto por parte de los individuos como de las instituciones.\u003C/p>\u003Cp name=\"073e\" id=\"073e\" class=\"graf graf--p graf-after--p\">En su meta-investigación, Dennis Friess y Christiane Eilders señalan que la mayoría de las investigaciones sobre la participación online se centra en los efectos sobre los individuos del diseño específico de las plataformas (por ejemplo, cómo el diseño afecta al proceso de participación: diseño-proceso).¹⁰ También afirman que existen relativamente pocos estudios que analicen «cómo el proceso de debate condiciona el resultado del debate (proceso-resultados)», y aún menos que analicen todos los aspectos de la participación digital (por ejemplo, desde la entrada de información, pasando por el debate, hasta la generación de resultados: diseño-proceso-resultados).¹¹ Haciéndose eco de Friess y Eilders, Tiago Peixoto y Jonathan Fox señalan que «aunque los medios cubren con un entusiasmo creciente las plataformas de participación facilitadas por las TIC, la investigación por parte de las ciencias sociales sobre las dinámicas y el impacto de estas iniciativas ha quedado muy atrasada, y las pruebas limitadas que tenemos en la actualidad no permiten un optimismo desmesurado».¹² Afirman que las pocas investigaciones disponibles se han centrado en analizar las aportaciones ciudadanas en la legislación resultante, así que no existen pruebas si estos sistemas online han tenido alcance, más allá de su capacidad para reforzar la transparencia gubernamental.¹³\u003C/p>\u003Cp name=\"2a07\" id=\"2a07\" class=\"graf graf--p graf-after--p\">Dicho todo esto, la participación online tiene muchos aspectos positivos que se pueden reforzar con un diseño mejorado y una mayor integración en las prácticas políticas y gubernativas. Capell, Price y Nir plantean, por ejemplo, «que la participación en los debates online puede generar un repertorio más amplio de argumentos, incluida una mayor conciencia de las razones que existen detrás de las visiones enfrentadas».¹⁴ Además, Davies \u003Cem class=\"markup--em markup--p-em\">et al.\u003C/em> destacan los beneficios de la «comunicación asincrónica», que ofrece a los participantes la oportunidad de contribuir al debate en el momento que más les convenga, de manera que se reducen las barreras de entrada y se promueve un diálogo más inclusivo y diverso.¹⁵ Janssen y Kies presentan más argumentos a favor de una comunicación asincrónica como un proceso que permite contribuciones más meditadas (frente a la comunicación instantánea a través del chat, donde es mucho más fácil que fracase la conversación).¹⁶ La participación pública a través de las TIC «reduce el coste de la participación al utilizar tecnología existente, limitando la necesidad de estar presentes en momentos determinados (o) incurrir en costes de localización tanto para los ciudadanos como para la administración».¹⁷\u003C/p>\u003Cp name=\"a687\" id=\"a687\" class=\"graf graf--p graf-after--p\">A medida que nos trasladamos de la teoría a la práctica, nuestras recomendaciones para el marco legal y el diseño de plataformas pretenden aumentar explícitamente el uso de la participación pública para mejorar la gobernanza como un objetivo primario. For the past three years, and again in 2026, he has been a Learning Guide and facilities for the NSW Leadership Academy (Band 1 and Band 2 senior executives).\u003C/p>\n\u003Cp>He chaired the former NSW Digital Government Advisory Panel and the Expert Advisory Group for the Welfare Payments Infrastructure Transformation program (WPIT) for the former federal Department of Human Services (now Services Australia).\u003C/p>\n\u003Cp>He was a member of the Government 2.0 Task Force established by Federal Minister for Finance, Lindsay Tanner, in 2009.
