CROWDLAW | RESUMEN DE RECOMENDACIONES: DISEÑAR LOS PROCESOS DE CROWDLAW PARA MEJORAR LA LEGITIMIDAD Y LA EFECTIVIDAD\u003C/strong>\u003C/h3>\u003Ch4 name=\"7e96\" id=\"7e96\" class=\"graf graf--h4 graf-after--h3 graf--subtitle\">\u003Cem class=\"markup--em markup--h4-em\">En esta sección resumimos las diez recomendaciones para el diseño razonado de iniciativas de crowdlaw organizadas alrededor de: clarificar la demanda de participación, aumentar el número de participantes y de información pública, y experimentar y mejorar las iniciativas. Las recomendaciones son relevantes para todas las fases del proceso legislativo.\u003C/em>\u003C/h4>\u003Cp name=\"0620\" id=\"0620\" class=\"graf graf--p graf-after--h4\">\u003Cstrong class=\"markup--strong markup--p-strong\">\u003Cem class=\"markup--em markup--p-em\">Este es un borrador del informe (de fecha 12 de octubre de 2017) y se actualizará en noviembre.\u003C/em>\u003C/strong>\u003C/p>\u003Cp name=\"1207\" id=\"1207\" class=\"graf graf--p graf-after--p\">Lo que distingue los procesos de crowdlaw que han tenido éxito no es la elección de la plataforma tecnológica, sino si el sistema está bien integrado en los mecanismos del proceso legislativo. ¿La participación va más allá de las simples sugerencias para transformarse en una participación constructiva? ¿La participación pretende fortalecer un compromiso significativo? ¿La tarea se realiza con las personas del público integradas en el flujo de trabajo del equipo profesional? Estas recomendaciones resumen nuestras conclusiones principales sobre la mejor manera de diseñar iniciativas para que el crowdlaw incremente la legitimidad y la efectividad del proceso legislativo.\u003C/p>\u003Ch3 name=\"0ab0\" id=\"0ab0\" class=\"graf graf--h3 graf-after--p\">\u003Cstrong class=\"markup--strong markup--h3-strong\">Clarificar la demanda de participación\u003C/strong>\u003C/h3>\u003Cp name=\"e5ac\" id=\"e5ac\" class=\"graf graf--p graf-after--h3\">1. \u003Cstrong class=\"markup--strong markup--p-strong\">Optimizar tanto la participación institucional como la pública.\u003C/strong> Los diseñadores de crowdlaw se concentran en conseguir que las aportaciones públicas sean fáciles para los individuos, pero el éxito de cualquier proceso también necesita que las aportaciones sean útiles para las instituciones. Por ello, se deben considerar las necesidades del gobierno y de los funcionarios públicos, y crear plataformas y procesos que tengan en cuenta los procedimientos obligatorios e integrados en la cultura funcionarial, y las habilidades del equipo profesional. Este principio no descarta cambios en los procedimientos legales o la contratación de personas con habilidades imprescindibles para facilitar la participación pública, pero debe existir un flujo de trabajo que consiga que las aportaciones de la participación sean utilizables. Por ejemplo, de los 2 millones de peticiones presentadas en la plataforma de e-peticiones de la Casa Blanca \u003Ca href=\"https://petitions.whitehouse.gov/\" data-href=\"https://petitions.whitehouse.gov/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">\u003Cem class=\"markup--em markup--p-em\">We the People\u003C/em>\u003C/a>, ninguna de ellas se puede relacionar directamente con una acción de gobierno, presumiblemente porque una petición sin documentación que la apoye aumenta, en lugar de aliviar, el trabajo de los funcionarios públicos. Este tipo de plataformas no están bien diseñadas para facilitar la toma de decisiones y tampoco crean un proceso estable para canalizar la información correcta al legislador adecuado.¹\u003C/p>\u003Cp name=\"4e8f\" id=\"4e8f\" class=\"graf graf--p graf-after--p\">2. \u003Cstrong class=\"markup--strong markup--p-strong\">Diseñar para alcanzar la meta deseada.\u003C/strong> La participación pública tiene el potencial de fortalecer la legitimidad democrática, reforzar la cohesión social, aumentar la responsabilidad gubernamental, y mejorar la calidad de la legislación. Un proceso de participación que pregunta a las personas cómo se sienten ante un proyecto de ley alcanza objetivos diferentes a los de un proceso que les pida, por ejemplo, que aporten datos para fundamentar la redacción de la ley, o que les invite a utilizar los teléfonos móviles para controlar su implantación. La elección de objetivos dictará lo que constituye un sistema de éxito y \u003Cstrong class=\"markup--strong markup--p-strong\">la información o la acción que se pretende del público\u003C/strong>. Así, si el objetivo es conseguir propuestas de implantación, no se pueden pedir solo ideas. Se tienen que pedir ideas apoyadas en pruebas. En el caso de \u003Cem class=\"markup--em markup--p-em\">Peer to Patent\u003C/em>, que fue una propuesta de una agencia administrativa, no de la rama legislativa, la Oficina de Patentes de los Estados Unidos pidió a los participantes que aportaran información que ayudaría a un examinador de patentes a determinar si un invento cumple los criterios para convertirse en una patente. Pero no preguntaban la opinión de la gente sobre la patente en sí, porque eso habría sido irrelevante para el proceso de toma de decisiones.\u003C/p>\u003Cp name=\"5438\" id=\"5438\" class=\"graf graf--p graf-after--p\">3. \u003Cstrong class=\"markup--strong markup--p-strong\">Identificar quién debe gestionar el proceso.\u003C/strong> Una evidencia que surgía constantemente de nuestro análisis de los casos globales era que la moderación del debate durante la participación tiene una importancia capital. Una mala moderación puede provocar con rapidez el descarrilamiento del proceso y dejar a los participantes confusos y frustrados. Aunque la moderación de una comunidad \u003Cem class=\"markup--em markup--p-em\">peer-to-peer\u003C/em> permite difuminar esta tarea al invitar al público para que se moderen entre ellos, a través de la valoración positiva o negativa de las propuestas, y calificando las contribuciones como \u003Cem class=\"markup--em markup--p-em\">spam\u003C/em> o abusivas, el plan también debe incluir un equipo profesional para responder y explicar cómo se van a utilizar las contribuciones del público. Esta es una parte importante del puente que conecta los participantes del público y del gobierno. Por ejemplo, \u003Ca href=\"https://edemocracia.camara.leg.br/home\" data-href=\"https://edemocracia.camara.leg.br/home\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">LabHacker/E-Democracia\u003C/a> en Brasil utiliza 200 asesores legislativos voluntarios que sirven como «traductores técnicos» entre los ciudadanos y los representantes, y contribuyen a asegurar que las aportaciones se ajustan a los requisitos legales.² De manera similar, los voluntarios facilitan el proceso en \u003Ca href=\"https://www.parlement-et-citoyens.fr/\" data-href=\"https://www.parlement-et-citoyens.fr/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">\u003Cem class=\"markup--em markup--p-em\">Parlement et Citoyens\u003C/em>\u003C/a>. La misma directiva se aplica a la participación offline: las asambleas ciudadanas coordinadas por \u003Ca href=\"http://www.wethecitizens.ie/\" data-href=\"http://www.wethecitizens.ie/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">\u003Cem class=\"markup--em markup--p-em\">We the Citizens\u003C/em> \u003C/a>de Irlanda tuvieron éxito en gran medida gracias al papel que desempeñaron moderadores muy capacitados.\u003C/p>\u003Cp name=\"68aa\" id=\"68aa\" class=\"graf graf--p graf-after--p\">4. \u003Cstrong class=\"markup--strong markup--p-strong\">Plan para su uso, no solo solicitudes.\u003C/strong> La participación pública sin un mecanismo de aprendizaje institucional para asumir contribuciones externas e integrarlas resulta frustrante para todos los implicados. Por analogía, el gobierno puede abrir y publicar los datos sobre las contrataciones públicas, pero esta transparencia por sí misma no reduce la corrupción. En su lugar, las instituciones públicas tienen que aprender a usar dichos datos para cambiar la manera como compran bienes y servicios. De la misma forma, en los órganos legislativos se deben incorporar la capacidad para asumir y usar las aportaciones del público. Es posible que esto requiera cambios en los procesos actuales de propuesta, redacción, negociación e implantación de la legislación. Tan importante como solicitar las aportaciones del público es que exista un mecanismo de aprendizaje adecuado para rediseñar cómo actúa el parlamento para beneficiarse de la participación.\u003C/p>\u003Ch3 name=\"190f\" id=\"190f\" class=\"graf graf--h3 graf-after--p\">\u003Cstrong class=\"markup--strong markup--h3-strong\">Aumentar la aportación de los participantes y de la información pública\u003C/strong>\u003C/h3>\u003Cp name=\"ba0c\" id=\"ba0c\" class=\"graf graf--p graf-after--h3\">5. \u003Cstrong class=\"markup--strong markup--p-strong\">Centrarse en los incentivos. Preguntarse: «¿por qué debería participar un miembro del público?» y obtener la respuesta hablando y sondeando a los usuarios potenciales.\u003C/strong> La literatura sobre crowdsourcing indica que la percepción de significado y de ecuanimidad es esencial para la calidad de las contribuciones y la viabilidad de las plataformas de crowdsourcing.³ La obligación de los gestores no consiste solo en diseñar un proceso que pueda tener un impacto significativo en el gobierno, sino también en articularlo para que tenga un impacto potencial en el público, al mismo tiempo que da facilidades para que sea posible. En otras palabras, hay que conseguir que el razonamiento para animar a la participación sea explícito y «vender» las razones para participar a través de un buen diseño y una explicación clara. En \u003Ca href=\"https://decide.madrid.es/\" data-href=\"https://decide.madrid.es/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">\u003Cem class=\"markup--em markup--p-em\">Decide Madrid\u003C/em>\u003C/a>, una plataforma creada por el Ayuntamiento de Madrid para la participación pública en la toma de decisiones, la sección en la que los usuarios pueden presentar propuestas es mucho más popular que la sección de debate porque las propuestas emocionan y tienen el potencial de generar cambios, mientras que los debates son simplemente un motor de más debates. Una encuesta a 482 usuarios que no se registraron en \u003Cem class=\"markup--em markup--p-em\">Decide Madrid\u003C/em> descubrió que para el 11% la participación era inútil y para un 27% que les faltaba tiempo para participar, que era la razón más citada para no participar.⁴ Si un individuo no se engancha rápidamente a una plataforma, será muy difícil superar estas reticencias a través de otros incentivos.\u003C/p>\u003Cp name=\"c0cf\" id=\"c0cf\" class=\"graf graf--p graf-after--p\">6. \u003Cstrong class=\"markup--strong markup--p-strong\">Explicar claramente cómo participar.\u003C/strong> El proceso legislativo es complejo, con muchas propuestas que nunca llegan a convertirse en ley. Por eso, una participación pública de éxito debe explicar el proceso y lo que se pide a los participantes, incluyendo la fijación de umbrales para la acción, como el número de firmas que se necesitan o qué debe contener un comentario para que se le tenga en cuenta. La literatura sobre crowdsourcing indica que cuando al «participante medio» se le «pide que realice una labor técnica con instrucciones específicas y una clasificación detallada de la tarea, sus resultados son iguales o mejores que los de un experto».⁵ Por ejemplo, en los informes anuales «Help Cut Red Tape» del \u003Ca href=\"https://engage.gov.bc.ca/govtogetherbc/consultation/help-cut-red-tape-public-engagement/\" data-href=\"https://engage.gov.bc.ca/govtogetherbc/consultation/help-cut-red-tape-public-engagement/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">\u003Cem class=\"markup--em markup--p-em\">GovTogetherBC\u003C/em>\u003C/a> de la Columbia Británica, se explica claramente de qué trata la participación, cómo se tendrán en cuenta las aportaciones y cuándo participar. Los informes detallan ideas populares para modernizar el gobierno, estadísticas sobre el proceso de participación, ideas presentadas y las acciones gubernamentales emprendidas sobre el tema (Figura 1). Dicha información ayuda a los participantes a comprender en tiempo real cómo su participación se está transformando en acción de gobierno. El proceso de \u003Ca href=\"https://www.lisboaparticipa.pt/\" data-href=\"https://www.lisboaparticipa.pt/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">Presupuesto Participativo de Lisboa\u003C/a> incrementó los votos desde los 2.800 en 2008 a los 29.000 en 2012 al mejorar la presencia y la claridad del proceso, al añadir un elemento que permitía a los ciudadanos seguir el estado de implantación de las propuestas aceptadas, establecer canales de participación a través de móvil e incluso visitar la ciudad con un «Autobús del Presupuesto Participativo».⁶\u003C/p>\u003Cfigure name=\"35a2\" id=\"35a2\" class=\"graf graf--figure graf-after--p\">\u003Cimg class=\"graf-image\" data-image-id=\"1*8wKQ5_l5bgBAKarOkTKZwQ.png\" data-width=\"1194\" data-height=\"873\" src=\"https://cdn-images-1.medium.com/max/800/1*8wKQ5_l5bgBAKarOkTKZwQ.png\">\u003Cfigcaption class=\"imageCaption\">\u003Cem class=\"markup--em markup--figure-em\">Figura 1: El Help Cut Tape Report de GovTogetherBC conecta ideas enviadas por los ciudadanos con las acciones específicas del gobierno sobre el&nbsp;tema\u003C/em>\u003C/figcaption>\u003C/figure>\u003Cp name=\"85e1\" id=\"85e1\" class=\"graf graf--p graf-after--figure\">7. \u003Cstrong class=\"markup--strong markup--p-strong\">Respetar la privacidad y autentificar a los usuarios cuando sea necesario.\u003C/strong> Aunque técnicamente es posible certificar la residencia o la identidad, se debe decidir si estos requisitos son necesarios y cuándo aplicarlos. Por ejemplo, si el objetivo es reunir las mejores ideas para resolver un problema, ¿importa de dónde vengan? Para ofrecer a las personas la oportunidad de participar en función de sus intereses, puede ser adecuada una encuesta voluntaria para recopilar información, pero no lo es una recopilación de datos obligatoria sobre las preferencias de la gente. Como un ejemplo de escrutinio de la participación, el Ayuntamiento de Reikiavik está obligado a considerar las 12–15 propuestas más populares cada mes en la plataforma \u003Ca href=\"https://betrireykjavik.is/domain/1\" data-href=\"https://betrireykjavik.is/domain/1\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">\u003Cem class=\"markup--em markup--p-em\">Mejor Reikiavik/Mejores Barrios\u003C/em>\u003C/a>, de manera que autentifican a los participantes mediante una ID electrónica o una contraseña que se entrega a través del banco digital del ciudadano para asegurarse que se trata de un-ciudadano-un voto. Como un ejemplo de una autentificación más compleja, \u003Ca href=\"https://decide.madrid.es/\" data-href=\"https://decide.madrid.es/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">\u003Cem class=\"markup--em markup--p-em\">Decide Madrid\u003C/em>\u003C/a> tiene un sistema en tres pasos que determina las acciones que pude realizar un miembro del público:\u003C/p>\u003Cp name=\"0dfa\" id=\"0dfa\" class=\"graf graf--p graf-after--p\">a. \u003Cem class=\"markup--em markup--p-em\">Usuarios no registrados\u003C/em> pueden consultar el contenido de la página.\u003C/p>\u003Cp name=\"12e1\" id=\"12e1\" class=\"graf graf--p graf-after--p\">b. \u003Cem class=\"markup--em markup--p-em\">Usuarios con verificación básica\u003C/em> — a través de los datos de residencia y un número de teléfono móvil — pueden participar en discusiones, así como crear y apoyar propuestas.\u003C/p>\u003Cp name=\"6479\" id=\"6479\" class=\"graf graf--p graf-after--p\">c. \u003Cem class=\"markup--em markup--p-em\">Usuarios con verificación completa\u003C/em> — comprobada en persona o a través de correo electrónico — pueden realizar todas estas acciones además de votar las propuestas.\u003C/p>\u003Cp name=\"6795\" id=\"6795\" class=\"graf graf--p graf-after--p\">8. \u003Cstrong class=\"markup--strong markup--p-strong\">Comunicar el resultado de las decisiones finales.\u003C/strong> Los funcionarios deberán responder a las contribuciones y establecer una comunicación regular sobre los resultados. Aunque el público solo esté invitado a participar en la realización de propuestas, al final se deberá crear un mecanismo para compartir los resultados finales. Por ejemplo, los participantes en \u003Ca href=\"https://vtaiwan.tw/\" data-href=\"https://vtaiwan.tw/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">\u003Cem class=\"markup--em markup--p-em\">vTaiwan\u003C/em>\u003C/a> establecen una deliberación permanente entre ellos y con representantes de los ministerios implicados. Los participantes saben que, si se alcanza un consenso, el gobierno taiwanés debe adoptar la idea o dar una respuesta de la razón por que la idea no es realizable.\u003Ca href=\"https://engage.gov.bc.ca/govtogetherbc/consultation/help-cut-red-tape-public-engagement/\" data-href=\"https://engage.gov.bc.ca/govtogetherbc/consultation/help-cut-red-tape-public-engagement/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\"> \u003Cem class=\"markup--em markup--p-em\">GovTogetherBC\u003C/em>\u003C/a> publica los resultados de todos los procesos. Por el otro lado, el sistema \u003Ca href=\"http://www.irekia.euskadi.eus/en\" data-href=\"http://www.irekia.euskadi.eus/en\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">\u003Cem class=\"markup--em markup--p-em\">Irekia\u003C/em>\u003C/a> del País Vasco (España) carece de un mecanismo para saber cuándo una propuesta ciudadana va a recibir una respuesta del gobierno o si se la considera aplicable, creando una ambigüedad sobre cuáles son los aspectos esenciales para que el gobierno se interese de verdad por una propuesta ciudadana.\u003C/p>\u003Cp name=\"80a6\" id=\"80a6\" class=\"graf graf--p graf-after--p\">9. \u003Cstrong class=\"markup--strong markup--p-strong\">Diversificar las oportunidades de participación y diversificar a los participantes.\u003C/strong> La investigación empírica sugiere que las oportunidades de participación pueden fracasar en el intento de atraer una participación diversa. Asegurar la participación de miembros diversos del público es una tarea muy compleja, que contempla la inversión en campañas para captar y dar voz a los sin voz. Un estudio de la representatividad de 186 de los participantes que contribuyeron con ideas para mejorar una ley de conducción todo terreno descubrió que eran predominantemente hombres (86%), tenían una educación formal y se encontraban entre los 35 y los 54 años (46%). También tenían una experiencia cívica previa: el 72% de los participantes habían escrito antes en un foro online, el 41% se había puesto en contacto con un representante, y el 33% había escrito antes un artículo de opinión.⁷ Atraer una participación diversa fue un reto común en todos los casos estudiados (detallados en la sección de análisis). Entre las causas del desequilibrio demográfico se encuentran el tiempo o la capacidad de los ciudadanos para realizar contribuciones, su desconocimiento de la plataforma, o su habilidad con la tecnología de la plataforma. Nuestro proyecto de ley esboza las oportunidades específicas para que los grupos puedan participar en el proceso legislativo sobre temas especialmente significativos (por ejemplo, centrados en temas específicos económicos, sociales, ambientales, culturales, de género o territoriales) como un paso decisivo para atraer activamente al proceso de participación a las poblaciones infrarrepresentadas.⁸ Así, además de una portal web online que permita que el público presente sus propuestas, participe en el diálogo y se comprometa en las actividades de un presupuesto participativo, los creadores de \u003Cem class=\"markup--em markup--p-em\">Decide Madrid\u003C/em> establecieron 26 «Oficinas de Atención al Ciudadano». Estas oficinas están distribuidas por toda la ciudad y permiten que los vecinos tengan la oportunidad de expresar sus opiniones en persona, si así lo desean, además o en lugar de su participación online. La reforma de la Constitución sudafricana incluyó una amplia estrategia de comunicación que distribuyó cuatro millones de ejemplares del borrador de la constitución durante la fase de redacción, y siete millones de ejemplares del documento final, entre ellos guías ilustradas para los sectores analfabetos de la población. He led strategy and design work on digital transformation and public policy and public sector reform projects in government, education, health, human services and urbanisation in India, China, South-East Asia, Australia and New Zealand.\u003C/p>\n\u003Cp>Prior to his role in Cisco, Martin held various policy and management roles in the federal public sector, including Chief of Staff to a Minister in the Federal Government, a federal public servant (Communications, Sport, Recreation and Tourism) and as a research and strategy lead in the Office of Strategic Planning in the NSW Cabinet Office. For the past three years, and again in 2026, he has been a Learning Guide and facilities for the NSW Leadership Academy (Band 1 and Band 2 senior executives).\u003C/p>\n\u003Cp>He chaired the former NSW Digital Government Advisory Panel and the Expert Advisory Group for the Welfare Payments Infrastructure Transformation program (WPIT) for the former federal Department of Human Services (now Services Australia).\u003C/p>\n\u003Cp>He was a member of the Government 2.0 Task Force established by Federal Minister for Finance, Lindsay Tanner, in 2009. In 2017, Martin was one of 3 members of a review for the NSW Government, chaired by former NSW Premier Nick Greiner AC, of regulatory policy and strategy across the State.\u003C/p>\n\u003Cp>He was an inaugural member of the NSW AI Advisory Group which crafted the early versions of what has now become the NSW AI Assurance Framework which is also being adapted as a national AI assurance framework.\u003C/p>\n\u003Cp>Martin writes and speaks extensively on government, service design, digital transformation, the impact of AI in government and on public leadership for the digital age as well as on different dimensions of policy reform.
