También definimos los objetivos del informe y proporcionamos una guía del mismo.\u003C/h4>\u003Cp name=\"3cdc\" id=\"3cdc\" class=\"graf graf--p graf-after--h4\">\u003Cstrong class=\"markup--strong markup--p-strong\">\u003Cem class=\"markup--em markup--p-em\">Este es un borrador del informe (de fecha 12 de octubre de 2017) y se actualizará en noviembre.\u003C/em>\u003C/strong>\u003C/p>\u003Cp name=\"0d68\" id=\"0d68\" class=\"graf graf--p graf-after--p\">Durante los últimos cinco años, 75 países se han integrado en el Open Government Partnership (OGP, asociación de gobierno abierto), que pretende «promover la transparencia, dar poder a los ciudadanos, luchar contra la corrupción y crear nuevas tecnologías para mejorar la gobernanza».¹ La extensión global del Gobierno Abierto — prácticas gubernamentales más transparentes y participativas — , acelerada por la aparición de tecnologías que facilitan la colaboración online, ha incrementado el interés en la revisión de los procesos gubernamentales que tradicionalmente se realizan a puerta cerrada. Ha aumentado el número de las plataformas de participación pública que modifican la finalidad inicial de las redes sociales existentes o utilizan ciertas plataformas web o apps móviles para facilitar las peticiones electrónicas, las innovaciones en la esfera del gobierno abierto\u003Ca href=\"#_ftn2\" data-href=\"#_ftn2\" class=\"markup--anchor markup--p-anchor\">*\u003C/a>, los presupuestos participativos y otras formas de participación por parte de órganos ejecutivos y administrativos. La tecnología permite ir más allá de las salas de reuniones tradicionales y otras formas de diálogo presencial² para generar más oportunidades, mucho más equilibradas, de participación que tienen el potencial de mejorar la calidad del diseño de las políticas a aplicar.\u003C/p>\u003Cp name=\"9057\" id=\"9057\" class=\"graf graf--p graf-after--p\">En paralelo a la implantación del gobierno abierto en el ámbito ejecutivo, los órganos legislativos han empezado a explorar — impulsados por las exigencias de la opinión pública — nuevos métodos para incorporar en su labor la inteligencia y la experiencia del público más allá de los comicios electorales, incluyendo maneras de mejorar los procesos legislativos. Este tipo de proceso legislativo participativo se conoce como «crowdlaw».³\u003C/p>\u003Cp name=\"6d9e\" id=\"6d9e\" class=\"graf graf--p graf-after--p\">\u003Cstrong class=\"markup--strong markup--p-strong\">CrowdLaw\u003C/strong> ofrece una alternativa al método tradicional del proceso legislativo, que habitualmente está en manos de un equipo de profesionales y políticos que trabajan a puerta cerrada. En el mundo, lo tradicional es que los partidos políticos acuerden en secreto la legislación y los compromisos legislativos. Para parafrasear un comentario periodístico reciente, que se puede aplicar a todos los órganos legislativos: en el parlamento, el secreto es una realidad.⁴\u003C/p>\u003Cp name=\"83bd\" id=\"83bd\" class=\"graf graf--p graf-after--p\">Formas limitadas de consulta pública offline en forma de audiencias públicas no son nada nuevo. No obstante, las nuevas tecnologías han ampliado extraordinariamente el uso de la participación en campos nuevos y en el papel que se pide que juegue la población. Ahora el público puede, en muchos casos, ir más allá aportando opiniones y formulando peticiones online⁵ para jugar un papel mucho más sustantivo, incluyendo propuestas legislativas, borradores de leyes, críticas a la legislación y aportando datos imprescindibles (Figura 1).⁶\u003C/p>\u003Cfigure name=\"96ee\" id=\"96ee\" class=\"graf graf--figure graf-after--p\">\u003Cimg class=\"graf-image\" data-image-id=\"1*TfhV28rGT9WGYy0m1m93hw.png\" data-width=\"1912\" data-height=\"766\" src=\"https://cdn-images-1.medium.com/max/800/1*TfhV28rGT9WGYy0m1m93hw.png\">\u003Cfigcaption class=\"imageCaption\">\u003Cem class=\"markup--em markup--figure-em\">Figura 1: Cuatro ejemplos de iniciativas de crowdlaw\u003C/em>\u003C/figcaption>\u003C/figure>\u003Cp name=\"7cd2\" id=\"7cd2\" class=\"graf graf--p graf-after--figure\">\u003Ca href=\"http://seguimiento.co/app-mi-senado\" data-href=\"http://seguimiento.co/app-mi-senado\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">\u003Cem class=\"markup--em markup--p-em\">Mi Senado\u003C/em>\u003C/a>: una aplicación para teléfono móvil que pretende «acercar los ciudadanos colombianos al legislativo», a través de facilitar el acceso a la información, de canales directos de comunicación con los senadores, y de oportunidades para votar en tiempo real. Los ciudadanos colombianos pueden reaccionar y votar en las sesiones plenarias parlamentarias en tiempo real y recibir notificaciones \u003Cem class=\"markup--em markup--p-em\">push\u003C/em> para saber cuándo se convocan las sesiones plenarias de manera que puedan participar. En la plataforma, los representantes pueden publicar una consulta que ofrece de tres a cinco oportunidades de participación diferentes (Figura 3). Por ejemplo, un representante plantea un problema que los ciudadanos ayudan a definir, y para el que pueden contribuir a generar una solución y evaluar las soluciones propuestas. Los ciudadanos también pueden participar en discusiones por videoconferencia con el representante. Al final del proceso, un informe de conclusiones explica si, cuándo y cómo se ha incorporado la aportación ciudadana en la propuesta legislativa resultante. (Los procesos de consulta, aunque patrocinados por los representantes que están presentes a lo largo de todo el proceso, en realidad están gestionados por voluntarios.)\u003C/p>\u003Cfigure name=\"3a41\" id=\"3a41\" class=\"graf graf--figure graf-after--p\">\u003Cimg class=\"graf-image\" data-image-id=\"1*xT_BTIeC5I50iuHQizmmlw.png\" data-width=\"1147\" data-height=\"902\" src=\"https://cdn-images-1.medium.com/max/800/1*xT_BTIeC5I50iuHQizmmlw.png\">\u003Cfigcaption class=\"imageCaption\">\u003Cem class=\"markup--em markup--figure-em\">Figura 3: Una consulta en 5 fases patrocinada por un representante\u003C/em>\u003C/figcaption>\u003C/figure>\u003Cp name=\"500e\" id=\"500e\" class=\"graf graf--p graf-after--figure\">\u003Ca href=\"https://edemocracia.camara.leg.br/\" data-href=\"https://edemocracia.camara.leg.br/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">\u003Cem class=\"markup--em markup--p-em\">E-Democracia\u003C/em>\u003C/a>: una plataforma de participación de The Hacker Lab que proporciona al público brasileño tres oportunidades de participación: (1) esbozar legislación colaborativa a través de \u003Cem class=\"markup--em markup--p-em\">WikiLegis\u003C/em>, (2) contactar con los diputados en la sección de discusión \u003Cem class=\"markup--em markup--p-em\">Expressão\u003C/em>, y (3) audiencias públicas a través de conferencias online con los representantes. Mediante estas herramientas, \u003Cem class=\"markup--em markup--p-em\">E-Democracia\u003C/em> permite que los ciudadanos propongan y editen textos legislativos (Figura 4) con múltiples oportunidades para que el gobierno responda. Los informes finales permiten que los ciudadanos comprendan si, cuándo y cómo su participación en la plataforma se ha incorporado a los borradores de la legislación.\u003C/p>\u003Cfigure name=\"c9f6\" id=\"c9f6\" class=\"graf graf--figure graf-after--p\">\u003Cimg class=\"graf-image\" data-image-id=\"1*wP8yql1QwPqZEsKXmoOWcQ.png\" data-width=\"1080\" data-height=\"1050\" src=\"https://cdn-images-1.medium.com/max/800/1*wP8yql1QwPqZEsKXmoOWcQ.png\">\u003Cfigcaption class=\"imageCaption\">\u003Cem class=\"markup--em markup--figure-em\">Figura 4: Redacción colaborativa de una ley en WikiLegis\u003C/em>\u003C/figcaption>\u003C/figure>\u003Cp name=\"3342\" id=\"3342\" class=\"graf graf--p graf-after--figure\">El crowdlaw tiene el potencial de mejorar la calidad del proceso legislativo al generar oportunidades para que el público aporte experiencia, información y opiniones con el objetivo de redactar leyes, reglamentos y constituciones que están mejor informadas y, al mismo tiempo, más legitimadas porque se han elaborado en público. A través de dichos procesos, el público se convierte en colaborador y co-creador en el proceso legislativo con el objetivo de mejorar la calidad de los resultados legislativos y la efectividad del gobierno.⁷\u003C/p>\u003Cp name=\"d91e\" id=\"d91e\" class=\"graf graf--p graf-after--p\">Pero, a pesar de estos ejemplos prometedores y apasionantes, el crowdlaw no está bien institucionalizado en la práctica parlamentaria. Los parlamentarios y los miembros del público que no están familiarizados con el proceso siguen siendo bastante escépticos. De hecho, los parlamentos, como otras instituciones públicas, se resisten con frecuencia a la participación pública, temiendo que sea una carga, en el peor de los casos, o inútil, en el mejor caso. Incluso cuando las instituciones ofrecen una oportunidad para participar, el público no está siempre informado ni dispuesto a hacerlo, sospechando que la participación no será relevante o no se incorporará en el resultado final. Los temores no carecen de fundamento porque muchos proyectos online de democracia participativa, ya sean legislativos o ejecutivos, han fracasado al no alcanzar el resultado deseado por las instituciones o los individuos. Por ejemplo:\u003C/p>\u003Cul class=\"postList\">\u003Cli name=\"50ed\" id=\"50ed\" class=\"graf graf--li graf-after--p\">\u003Cem class=\"markup--em markup--li-em\">Decide Madrid\u003C/em>, una iniciativa del Ayuntamiento de Madrid que reunió 18.000 propuestas políticas presentadas por el público participante, ha dado como resultado que solo dos de estas propuestas han sido consideradas por el Ayuntamiento.\u003C/li>\u003Cli name=\"882f\" id=\"882f\" class=\"graf graf--li graf-after--li\">En 2009 el equipo de transición del presidente electo Barack Obama pidió al pueblo americano propuestas políticas para los primeros cien días en el cargo del nuevo presidente. Aunque se recibieron más de 70.000 ideas en \u003Cem class=\"markup--em markup--li-em\">The People’s Briefing Book\u003C/em> y fueron votadas por más de medio millón de personas, ninguna de ellas se incorporó a las políticas aplicadas.⁸\u003C/li>\u003C/ul>\u003Ch3 name=\"880f\" id=\"880f\" class=\"graf graf--h3 graf-after--li\">\u003Cstrong class=\"markup--strong markup--h3-strong\">Integrar el crowdlaw en el proceso legislativo: más allá de la petición\u003C/strong>\u003C/h3>\u003Cblockquote name=\"3ded\" id=\"3ded\" class=\"graf graf--blockquote graf-after--h3\">En este periodo inicial de crowdlaw, las oportunidades de participación no están bien integradas en la práctica legislativa lo que provoca un gran aumento del volumen de información (sugerencias, comentarios, peticiones) sin que redunde en una mejora de la calidad de los resultados legislativos. Los extensos conocimientos y experiencias del público no encuentran una vía de entrada en la toma de decisiones en el momento apropiado y en un formato que se pueda utilizar. Si se diseñan sin tener en cuenta las necesidades tanto de los miembros del público participante como de las instituciones parlamentarias, las innovaciones en la participación online no mejorarán el proceso legislativo, sino que conducirán solo a la frustración, la desafección y la fatiga.\u003C/blockquote>\u003Cp name=\"d23e\" id=\"d23e\" class=\"graf graf--p graf-after--blockquote\">Sin embargo, diseñada de una manera correcta, la participación puede mejorar la legitimidad y la efectividad del proceso legislativo en cada fase del mismo al introducir más datos y puntos de vista diversos, y al garantizar que la legislación esté mejor informada de las condiciones de la vida real.\u003C/p>\u003Cp name=\"dfaf\" id=\"dfaf\" class=\"graf graf--p graf-after--p\">Alrededor del mundo, los experimentos de participación pública que han tenido éxito han incidido en cada una de las cinco fases básicas del proceso legislativo. Proporcionan una idea de cómo las prácticas de crowdlaw se pueden integrar en el proceso legislativo con el objetivo de aportar información del público para un gobierno mejorado. Aunque articulados como «\u003Ca href=\"https://en.wikipedia.org/wiki/Ideal_type\" data-href=\"https://en.wikipedia.org/wiki/Ideal_type\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">tipos ideales\u003C/a>», con aportaciones cruzadas significativas entre fases, los beneficios potenciales de cada etapa (Figura 5) son:\u003C/p>\u003Cfigure name=\"c7dd\" id=\"c7dd\" class=\"graf graf--figure graf-after--p\">\u003Cimg class=\"graf-image\" data-image-id=\"1*k26TdD60k7Xpaj2dUB3tzQ.png\" data-width=\"1672\" data-height=\"738\" src=\"https://cdn-images-1.medium.com/max/800/1*k26TdD60k7Xpaj2dUB3tzQ.png\">\u003Cfigcaption class=\"imageCaption\">\u003Cem class=\"markup--em markup--figure-em\">Figura 5: Fases del proceso legislativo y los aspectos de gobernanza que el público puede ayudar a mejorar en cada una de ellas\u003C/em>\u003C/figcaption>\u003C/figure>\u003Cp name=\"9a27\" id=\"9a27\" class=\"graf graf--p graf-after--figure\">\u003Cstrong class=\"markup--strong markup--p-strong\">1) Marcar la agenda:\u003C/strong> cuando los parlamentos deciden qué temas asumen para legislar sobre ellos. Muchos países tienen ya un proceso de peticiones muy bien establecido.⁹ Llevado online y rediseñado constituye potencialmente una oportunidad para aportar empirismo al proceso legislativo a través de la contribución pública de experiencias e información, ofreciendo al público la oportunidad de proponer, priorizar y criticar los problemas que se deben afrontar. Por ejemplo, en Finlandia la Ley de \u003Ca href=\"http://openministry.info/finnish-citizens-initiative\" data-href=\"http://openministry.info/finnish-citizens-initiative\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">Iniciativa Ciudadana\u003C/a> permite que los miembros del público propongan leyes nuevas. La Unión Europea ha adoptado su propia \u003Ca href=\"http://ec.europa.eu/citizens-initiative/public/welcome\" data-href=\"http://ec.europa.eu/citizens-initiative/public/welcome\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">Ley de Participación Ciudadana\u003C/a>. En México, la \u003Ca href=\"http://ley3de3.mx/\" data-href=\"http://ley3de3.mx/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">Ley 3de3\u003C/a> permitió que 634.000 personas pidieran la publicación de información financiera de los políticos para combatir la corrupción. Las reformas propuestas por la Ley 3de3 amparan la primera iniciativa ciudadana que ha tenido éxito al ser discutida y aprobada por el Congreso mexicano una ley que permite que se acepten propuestas legislativas ciudadanas que consigan 120.000 firmas.¹⁰ ¹¹\u003Cstrong class=\"markup--strong markup--p-strong\">En esta fase, la participación tiene el potencial de mejorar el nivel de información en el proceso legislativo.\u003C/strong>\u003C/p>\u003Cp name=\"cf28\" id=\"cf28\" class=\"graf graf--p graf-after--p\">\u003Cstrong class=\"markup--strong markup--p-strong\">2) Presentación de propuestas:\u003C/strong> cuando los órganos legislativo y regulatorio llegan a plantear una solución para un problema. Esto representa una oportunidad para identificar enfoques innovadores mediante la difusión de experiencias diversas y sugerir, debatir y criticar los enfoques propuestos. Dichos enfoques amplían la aportación del público más allá de lo que está a disposición de los legisladores y sus equipos a través de audiencias ocasionales. Por ejemplo, \u003Ca href=\"https://www.parlement-et-citoyens.fr/\" data-href=\"https://www.parlement-et-citoyens.fr/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">\u003Cem class=\"markup--em markup--p-em\">Parlement et Citoyens\u003C/em>\u003C/a> en Francia permite que los ciudadanos presenten propuestas sobre las causas y las soluciones al problema planteado por el representante. Posteriormente, las propuestas ciudadanas son sintetizadas, debatidas e incorporadas al borrador legislativo resultante. \u003Cstrong class=\"markup--strong markup--p-strong\">En esta fase, la participación tiene el potencial de mejorar la innovación.\u003C/strong>\u003C/p>\u003Cp name=\"7cfd\" id=\"7cfd\" class=\"graf graf--p graf-after--p\">\u003Cstrong class=\"markup--strong markup--p-strong\">3) Redacción:\u003C/strong> cuando los órganos legislativos fijan las soluciones a través de un proyecto de legislación, reglamento o constitución. Esto proporciona una oportunidad para una redacción colaborativa y para solicitar comentarios sobre un borrador para mejorarlo. Al incrementar el acceso a una función central del gobierno, la redacción colaborativa genera un ímpetu radical para una mayor abertura. Por ejemplo, \u003Ca href=\"https://edemocracia.camara.leg.br/\" data-href=\"https://edemocracia.camara.leg.br/\" class=\"markup--anchor markup--p-anchor\" rel=\"noopener\" target=\"_blank\">el WikiLegis de E-Democracia\u003C/a> permite que los brasileños editen borradores de textos legislativos de una manera parecida al trabajo colaborativo en un documento de Google. \u003Cstrong class=\"markup--strong markup--p-strong\">En esta fase, la participación tiene el potencial de aumentar la transparencia.\u003C/strong>\u003C/p>\u003Cp name=\"f889\" id=\"f889\" class=\"graf graf--p graf-after--p\">\u003Cstrong class=\"markup--strong markup--p-strong\">4) Implementación:\u003C/strong> cuando los órganos legislativos delegan en los organismos o equipos administrativos que pongan en práctica las leyes. Esto implica con frecuencia un paso adicional al redactar reglamentos basados en la legislación y plantear estrategias para convertir la letra de la ley en acciones prácticas. Dicho proceso de creación de normas representa otra oportunidad para la participación. The Impact Assembly as part of PwC’s social impact practice.\u003C/p>\n\u003Cp>He is an ANZSOG Practice Fellow for Digital Government Strategy and Leadership and the founder and principal of Public Purpose Pty Ltd, working at the intersection of public policy, strategy, leadership and technology. He has led the development of new programs exploring the public leadership implications of digital, data and AI, including the role of ethics and ethical frameworks for public leaders. He co-directs ANZSOG’s Deputies Leadership Program with Kathryn Anderson, that integrates a significant focus on the evolution of leadership responses to the opportunities and risks of digital, data and AI capabilities and platforms.\u003C/p>\n\u003Cp>From 2001 to 2013, Martin led the Asia-Pacific public sector consulting and innovation team in Cisco’s Internet Business Solutions Group (IBSG). He led strategy and design work on digital transformation and public policy and public sector reform projects in government, education, health, human services and urbanisation in India, China, South-East Asia, Australia and New Zealand.\u003C/p>\n\u003Cp>Prior to his role in Cisco, Martin held various policy and management roles in the federal public sector, including Chief of Staff to a Minister in the Federal Government, a federal public servant (Communications, Sport, Recreation and Tourism) and as a research and strategy lead in the Office of Strategic Planning in the NSW Cabinet Office. For the past three years, and again in 2026, he has been a Learning Guide and facilities for the NSW Leadership Academy (Band 1 and Band 2 senior executives).\u003C/p>\n\u003Cp>He chaired the former NSW Digital Government Advisory Panel and the Expert Advisory Group for the Welfare Payments Infrastructure Transformation program (WPIT) for the former federal Department of Human Services (now Services Australia).\u003C/p>\n\u003Cp>He was a member of the Government 2.0 Task Force established by Federal Minister for Finance, Lindsay Tanner, in 2009. In 2017, Martin was one of 3 members of a review for the NSW Government, chaired by former NSW Premier Nick Greiner AC, of regulatory policy and strategy across the State.\u003C/p>\n\u003Cp>He was an inaugural member of the NSW AI Advisory Group which crafted the early versions of what has now become the NSW AI Assurance Framework which is also being adapted as a national AI assurance framework.\u003C/p>\n\u003Cp>Martin writes and speaks extensively on government, service design, digital transformation, the impact of AI in government and on public leadership for the digital age as well as on different dimensions of policy reform.
